1 - TERMS, CONDITIONS OF SALE AND SHIPPING 

General Terms and Conditions

This contract qualifies as a distance contract pursuant to and for the purposes of Article 50 et seq. of Legislative Decree No. 206 of 6 September 2005 (Consumer Code).
The object of the contract is the sale of extra virgin olive oil and/or derivative products between the proposer and the consumer (the customer).
The contract is concluded directly with the acceptance by the company of a purchase proposal by telephone or via the Internet following the invitation to offer contained in the website or Instagram profile.

Terms of sale

The purchases of the products, available as illustrated and described online in the relative descriptive and technical sheets, are made by the customer at the price indicated online, at the time of forwarding the order confirmation, in addition to the transport costs, as displayed on of the purchase. Before confirming the purchase to the customer, the unit cost of each selected product will be summarized, the total cost in the case of multiple products and the related transport costs and the total VAT. The prices of the products displayed for sale are inclusive of VAT.

Delivery and shipment of products

The purchased products will be delivered to the shipping address indicated by the customer.
Always indicate a telephone number for any communications or emails. Unless otherwise agreed, shipments shall be made by carriers defined by the proposer or his delegate. The goods travel at the risk of the proposer and in the event of theft or loss the proposer undertakes to send a new product with the same characteristics. The delivery time, which is purely indicative, is approximately 2/4 weeks from the date of the order; it may vary due to force majeure or due to traffic and road conditions in general or by act of the Authorities.
Delivery, unless otherwise agreed in writing between the parties, shall take place during office hours: from 8.30 a.m. to 12.30 p.m.; from 3.30 p.m. to 7.30 p.m., every day, non-holiday, Monday to Friday.
The customer shall verify that the package is undamaged and undamaged. Only after such verification shall the customer accept the delivery.
In the event that the package represents visual anomalies with respect to the above, the customer shall raise the objection directly with the carrier, not collect the goods and send an e-mail via the site.

Right of withdrawal

The proposer guarantees the right of withdrawal for any reason from the purchase contract. To exercise this right, a registered letter with return receipt must be sent specifying the order number and which products are subject to return. All within 10 days of receipt of goods. The right of withdrawal is in any case subject to the following conditions: 1) the purchased good must be returned unused and intact, in its original packaging complete in all its parts (including the packaging and documentation and accessory equipment; 2) in accordance with the law, the costs will be charged to the customer; 3) the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer. We are not liable in any way for damage or theft/loss of goods returned by uninsured or untracked shipments (e.g. priority mail); 4) in the event of damage to the goods during transport, we will take care to promptly notify the customer of the incident (within 5 working days of receipt of the goods) to allow him to file a complaint against the courier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, simultaneously canceling the request for withdrawal; 5) if, on the other hand, the return is returned intact in all the aforementioned points, we will reimburse the cost of the goods only (not the shipping costs) by bank transfer 10 days after receiving the return. For any dispute between the parties in this regard, the Court of Bologna has exclusive jurisdiction.

Product guarantee

• All products marketed (excluding used components) by the proponent are covered by the conventional 24-month warranty for lack of conformity, pursuant to Legislative Decree n. 24/02. To use the warranty assistance, the Customer must keep the invoice (or DDT) that he will receive together with the purchased goods.
• The 24-month guarantee pursuant to Legislative Decree n. 24/02 applies to products that present a lack of conformity, provided that the same is used correctly, in compliance with its intended use and with the provisions of the attached documentation. This guarantee, in accordance with Legislative Decree N. 24/92, is reserved only to the private consumer (natural person who buys the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, the offeror shall restore the conformity of the product by means of replacement or a reduction in price, at no cost to the Customer, until the termination of the contract. If it should not be a lack of conformity, pursuant to Legislative Decree n. 24/02, the Customer will be charged for any verification costs, as well as transport costs if incurred by the proponent. 
• n the event that, for any reason, the offeror is unable to replace a product under warranty (restored or replaced), he may proceed, with the Customer's consent, to replace the product itself (if still in the price list) or with another of equal characteristics and value or, finally, to the issue of a discount voucher for the same amount that can be spent on another product valid for 6 months from the time of issue.
• No damage can be requested from the proponent for any delays in the replacement of products under warranty.
• In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts; to limit damage to the original packaging, it is recommended, when possible, to place it in a second box; the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided in all cases.
